How to leave a gift in your Will

It is important to have a Will to ensure your estate is given to the people and causes that you care about. By making a Will, you have the power to choose how your assets are used. They needn’t be expensive or complicated to prepare, but legal advice will ensure your Will is clear and effective, and importantly – reflects your wishes. Reviewing your Will every few years is also important, as circumstances, such as such as marriage, sale of a property, birth of children or grandchildren, and changes to family relationships, change throughout your life.

Types of gifts

When you decide to leave a gift to the Abbotsford Convent Foundation in your Will, you have flexibility in how you can choose to include this legacy gift around other the beneficiaries in your world. Different types of gifts include:

  • Residuary: The remainder of an estate after specific gifts have been disbursed.
  • Percentage: A percentage of either the residue or the entire estate.
  • Specific Asset: Real estate shares, bonds or other particular items of value.
  • Pecuniary: A specific gift of cash.

Suggested wording

Once you’ve decided on the type of bequest you’d like to make, ask your solicitor to draft a clause. The following words are a guide only and subject to your solicitor’s advice:

“I hereby give, free of all duties or taxes, to the Abbotsford Convent Foundation (ABN 79 492 202 447)…

[Please insert here the appropriate statement selected from the 6 options below:]

  1. the whole of my estate
  2. [insert number] percent of my estate
  3. the residue of my estate
  4. [insert number] percent of the residue of my estate
  5. the sum of $ [insert value of your gift]
  6. [insert number] of my [insert name of shares] shares

…for its general purposes. The official receipt of the organisation shall be a full and sufficient discharge to my executor.”

Updating an existing Will

If you’d like to include Abbotsford Convent Foundation in your existing Will, you may simply like to add a Codicil (an amendment to your Will). Codicils are a simple and effective way to make updates without re-writing your entire Will. You’ll need to ensure it is signed and witnessed by a solicitor or Public Trustee.
